Asbo for Youth Who Terrorised Neighbourhood - 13 August 2008


A youth whose antisocial behaviour terrorised fellow residents in an area of East Edinburgh for more than two years has been banned from a large swathe of the neighbourhood.

The City of Edinburgh Council were granted an interim Antisocial Behaviour Order (ASBO) against Daniel Baird of Bingham Way at Edinburgh Sheriff Court on 28 July 2008.

Under the terms of the order, the youth, who will be 17 on 24 April, is banned from a designated 'exclusion zone' covering 12 streets in Bingham and Magdalene in East Edinburgh.

Despite signing four Acceptable Behaviour Contracts between 2005 and 2007, and having ignored several warning letters about his behaviour, Baird persisted in engaging in conduct which caused real alarm and distress to residents in the affected areas.

He had also refused repeated offers of support from the local Community Safety team and Police, including working with a Youth Inclusion Worker.

The Sheriff Court, in considering the application for the ASBO, heard that Baird's antisocial behaviour included: shouting, swearing, antisocial drinking, singing, fighting, threatening residents, smashing bottles, urinating and littering fast food containers, cigarettes and drug paraphernalia within common stair areas. This behaviour has caused considerable alarm and distress to numerous fellow residents.

Councillor Paul Edie, Community Safety Leader, said: "Behaviour of this nature is totally unacceptable and will not be tolerated. We have made every effort to persuade this individual to change his behaviour, using Acceptable Behaviour Contracts because of his young age and offering assistance and support on numerous occasions. However, since he has chosen to disregard all support offered to him, we had no choice but to seek an ASBO against him."

Susan Mooney, East Neighbourhood Manager, said: "This is the second ASBO in this area and should send a strong message to the local community that we will are continuing to take tough action against those who make their fellow residents' lives a misery by their persistent antisocial behaviour."
